أصدرت محكمة استئناف القاهرة الاقتصادية حكمها النهائي في النزاع القضائي بين الفنانة المصرية عفاف شعيب والمخرج المصري محمد سامي، بعد استئناف شعيب على حكم ابتدائي رفض دعواها للتعويض بمبلغ 5 ملايين جنيه بسبب اتهامات سب وقذف.
رفض الاستئناف
وأكدت المحكمة في حيثيات القرار أن الحكم الأصلي كان دقيقًا من الناحيتين القانونية والواقعية، وأن الاستئناف لم يقدم أي مستندات أو دفوع جديدة من شأنها تعديل نتائج القضية، ما دفعها إلى رفض الدعوى بالكامل المقدمة من عفاف شعيب.
غياب الأدلة المؤثرة
وأشارت المحكمة إلى أن أوراق القضية لم تحتو على أي دليل ملموس يبرر تغيير الحكم، مما عزز موقف المخرج محمد سامي أمام القضاء، وجعل دعوى التعويض غير قابلة للنجاح.
تكاليف المصروفات القانونية
كما ألزم الحكم الفنانة بدفع المصروفات القضائية وأتعاب المحاماة البالغة 100 جنيه، في إطار تأكيد المحكمة على التزام الطرف الخاسر بالتحمل المالي للتقاضي.
خلفية قضائية ببراءة سامي
ويأتي هذا القرار بعد أن حصل محمد سامي على حكم سابق بالبراءة من محكمة جنح مستأنف أكتوبر، ما ساعد في تدعيم موقفه أمام المحكمة الاقتصادية وأضعف فرص نجاح دعوى التعويض.
The Cairo Economic Court of Appeal issued its final ruling in the legal dispute between Egyptian actress Afaf Shuaib and Egyptian director Mohamed Sami, after Shuaib appealed a preliminary ruling that rejected her claim for compensation of 5 million pounds due to allegations of defamation and slander.
Rejection of the Appeal
The court confirmed in the reasoning of its decision that the original ruling was accurate from both a legal and factual standpoint, and that the appeal did not present any new documents or defenses that could alter the outcome of the case, which led it to reject the lawsuit entirely filed by Afaf Shuaib.
Lack of Compelling Evidence
The court pointed out that the case files did not contain any tangible evidence justifying a change in the ruling, which strengthened director Mohamed Sami’s position before the judiciary and rendered the compensation claim unsuccessful.
Legal Costs
The ruling also obligated the actress to pay the legal fees and attorney’s fees amounting to 100 pounds, as part of the court’s emphasis on the losing party’s obligation to bear the financial costs of litigation.
